Overturning the Safe Drug Disposal Ordinance

Pharmaceutical industry groups, such as PhRMA, BIO, and GPhA, have petitioned the Supreme Court to overturn a local ordinance requiring pharmaceutical companies to conduct and pay for safe medicine disposal programs in local counties or pay a penalty of $1,000  per day. Industry groups argue that the 2012 Safe Drug Disposal Ordinance is a violation of their constitutional rights pursuant to the Commerce Clause because by requiring interstate drug manufacturers to conduct and pay for programs, the cost of local regulations are shifted onto the interstate market.
