Next year, a set of regulations under the Affordable Care Act will go into effect that could affect common hiring practices for many businesses. The “play or pay” rules mandate that an employer must offer coverage that is affordable and provides sufficient value to 95 percent of its full-time employees or face steep penalties under the health care law. Under the new regulations, the definition of an “employee” may also include temporary workers supplied by a staffing agency. Employers who use staffing agencies would need to reconsider the number of employees that are required to have coverage under the new rules in order to avoid penalties.
